Citizen enforcer Russell Brimer’s allegations against defendant AAMP of Florida, Inc. dba AAMP of America, Inc. (“AAMP”) were resolved on June 2, 2013, when the parties executed a Consent Judgment.  In this matter, Brimer alleged that AAMP sold vinyl/PVC USB cables containing the phthalate chemical di(2-ethylhexyl)phthalate (“DEHP”) in the State of California without providing the requisite health hazard warnings.

As part of the settlement, AAMP agreed not to sell any vinyl/PVC USB cables in California after the Alameda County Superior Court approves the Consent Judgment, unless the cables contain no more than 1,000 parts per million of DEHP when analyzed using state or federally approved testing methodologies.  Should AAMP provide written certification by June 1, 2014, that all cables sold in California qualify as reformulated, Brimer agreed to waive a portion of the civil fine. 

The Consent Judgment requires settlement payments of $35,000, divided therein between civil penalties, 75% of which are paid to California’s Office of Environmental Health Hazard Assessment, and compensation to whistleblower Brimer and his counsel for their successful enforcement of this matter in the public interest.
