Brimer v. Camping World, Inc.; CWI, Inc.; et al.

On February 24, 2012, the Alameda County Superior Court entered a Consent Judgment in Brimer v. Camping World, Inc.; et al., which resolved citizen enforcer Russell Brimer's allegations that the defendants Camping World, Inc. and CWI, Inc. (collectively "Camping World") sold tire pressure gauges containing the heavy metal lead in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Camping World agreed not to sell any tire pressure gauges in California after October 7, 2011, unless the tire pressure gauges met the reformulation standards pursuant to Section 2.1 of the Consent Judgment or had Proposition 65 warnings provided.  Due to Camping World's commitment to comply by these heightened standards, Brimer agreed to credit Camping World with a portion of the civil fine that would otherwise be applied.

The Consent Judgment requires settlement payments of $42,000, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower Brimer and his counsel for their successful enforcement of this matter in the public interest.
