Brimer v. Carrini, Inc.

The San Francisco County Superior Court entered a Consent Judgment in Brimer v. Carrini, Inc., on November 27, 2012.  This enforcement action resolved citizen enforcer Russell Brimer's allegations that the defendant Carrini, Inc. ("Carrini") sold footwear containing the heavy metal lead in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Carrini also agreed not to sell any footwear in California after November 27, 2012, unless the footwear complies wtih the reformulation standards set forth in Section 3.2 of the Consent Judgment.  Additionally, Carrini agreed to provide the lead standards to its then-current vendors of footwear that will be sold to California consumers and to instruct each vendor to provide footwear that complies with the standards on a nationwide basis.

The Consent Judgment requires settlement payments of $47,000, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower Brimer and his counsel for their successful enforcement of this matter in the public interest.
