Brimer v. CBS Broadcasting, Inc., et al.

On March 8, 2007, the San Francisco County Superior Court entered a Consent Judgment in Brimer v. CBS Broadcasting, Inc., et al., which resolved citizen enforcer Russell Brimer's allegations that CBS Broadcasting, Inc. ("CBS") sold glasses and ceramic mugs with colored artwork on the surface containing the heavy metal lead and cadmium in the State of California without providing the requisite health hazard warnings.

As part of the settlement, CBS agreed not to sell any of the specific glasses or ceramic mugs identified in the Consent Judgment in California after November 30, 2006, unless the glassware and ceramicware have Proposition 65 warnings provided.

The Consent Judgment requires settlement payments of $42,000, to be divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower Brimer and his counsel for their successful enforcement of this matter in the public interest.
