Brimer v. Hampton Products International Corporation, et al.

On April 21, 2011, the San Francisco County Superior Court entered a Consent Judgment in Brimer v. Hampton Products International Corporation; et al., which resolved citizen enforcer Russell Brimer's allegations that the defendant Hampton Products International Corporation ("Hampton") sold rachet tie-downs with handles containing the heavy metal lead on the exterior surface in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Hampton agreed not to sell any rachet tie-downs with handles in California unless the rachet tie-downs contain less than 1.0 microgram of lead when analyzed using state or federally approved testing methodologies. Hampton also agreed to place Proposition 65 warnings on the rachet tie-downs it did not reformulate.

The Consent Judgment requires settlement payments of $60,000, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation for whistleblower Brimer and his counsel for their successful enforcement of this matter in the public interest.
