Brimer v. Screen–It Graphics of Lawrence, Inc., et al.

The Honorable Frank Roesch entered a Consent Judgment in Brimer v. Screen–It Graphics of Lawrence, Inc., et al. on August 1, 2007. In this enforcement action, citizen enforcer Russell Brimer alleged that defendants Screen–It Graphics of Lawrence, Inc. and Grandstand Sportsware and Glassware (collectively “Screen-It”) sold pilsner glasses and other glassware with colored artwork on the exterior containing the heavy metal lead in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Screen-It agreed not to sell any pilsner glasses or other glassware in California after May 22, 2007, unless the glassware has Proposition 65 warnings provided or contains no more than 0.06 percent of lead by weight in each material used in the products.

Due to Screen-It’s prompt cooperation in the settlement, Brimer agreed to credit a portion of the civil fine that would otherwise be applied. 

The Consent Judgment requires settlement payments of $110,000, to be divided therein between civil penalties, 75% of which are paid to California’s Office of Environmental Health Hazard Assessment, and compensation to whistleblower Brimer and his counsel for their successful enforcement of this matter in the public interest.
