Brimer v. Solo Cup Company, et al.

Citizen enforcer Russell Brimer's enforcement action against defendants Solo Cup Company dba Creative Expressions Group and Solo Cup Operating Corporation (collectively "Solo") was resolved on November 21, 2007, when the San Francisco County Superior Court granted the parties' motion to approve the Consent Judgment in Brimer v. Solo Cup Company, et al. In this matter, Brimer alleged that Solo sold mugs and other ceramic containers with colored artwork containing the heavy metal lead on the exterior in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Solo agreed not to sell any mugs or other ceramic containers in California after August 31, 2007, unless the ceramicware complies with reformulation standards when analyzed using state or federally approved testing methodologies.

The Consent Judgment requires settlement payments of $21,000, to be divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower Brimer and his counsel for their successful enforcement of this matter in the public interest.
