Brimer v. Taylor Precision Products, Inc.

The parties involved in the case Brimer v. Taylor Precision Products, Inc. executed a Consent Judgment on August 27, 2015.  In this matter, citizen enforcer Russell Brimer alleged that Taylor Precision Products, Inc. (“Taylor”) sold glass shakers with exterior designs that contain lead in the State of California without providing the requisite health hazard warnings.  

As part of the agreement, Taylor agreed not to sell any glass shakers with exterior designs in California after the San Francisco County Superior Court approves the Judgment, unless the shakers contain no more than 90 parts per million (“ppm”) of lead when analyzed using state or federally approved testing methodologies.  Should Taylor provide written certification that all glass shakers with exterior designs sold in California qualify as reformulated by February 15, 2016, Brimer agreed to waive a portion of the civil fine that would otherwise be applied.

The Consent Judgment required settlement payments of $53,000, divided therein between civil penalties, 75% of which are paid to California’s Office of Environmental Health Hazard Assessment, and compensation to whistleblower Brimer and his counsel for their successful enforcement of this matter in the public interest.
