DiPirro v. Adams Apple Distributing, L.P., et al.

On February 26, 2003, the Alameda County Superior Court entered a Consent Judgment in DiPirro v. Adams Apple Distributing, L.P., et al., which resolved citizen enforcer Michael DiPirro's allegations that the defendant Adams Apple Distributing, Inc. sold light bulbs with one or more solder points on the base containing lead in the State of California without providing the requisite Proposition 65 health hazard warnings.

As part of the settlement, Adams agreed not to sell in California light bulbs with one or more solder points on the base containing lead and which yield more than .1% lead by weight when analyzed pursuant to state and federally approved testing methodologies.

The Consent Judgment requires settlement payments of $43,500, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
