A Consent Judgment in the DiPirro v. Amerway, Inc., et al. matter, heard in the Alameda County Superior Court, was entered on September 18, 2002. The Consent Judgment resolved citizen enforcer Michael DiPirro's allegations that the defendants Amerway, Inc. and Grobet File Company of America, Inc. (collectively "Amerway") sold solder products containing lead in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Amerway has agreed to no longer sell the solder products containing lead in California, but if they choose to sell the products in California again in the future, it will utilize Proposition 65 health hazard warnings.

The Consent Judgment requires settlement payments of $19,900, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
