The San Francisco County Superior Court entered a Consent Judgment in DiPirro v. Big Lots Stores, Inc., et al. on August 18, 2003. This settlement resolved the allegations of citizen enforcer Michael DiPirro that defendant Big Lots Stores, Inc. sold certain photo frames, stained glass lamps, and candle/votive holders containing lead in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Big Lots agreed not to sell or offer for sale any photo frames, stained glass lamps or candle/votive holders in California after April 11, 2003, unless such products bear Proposition 65 health hazard warnings pursuant to Section 1.0 of the settlement agreement. Additionally, Big Lots agreed to send instructions to all Big Lots retail stores with remaining inventory of products to remove all products until appropriate warnings were affixed.

The Consent Judgment requires settlement payments of $30,000, divided therein between Health Risk Consultants, Inc., and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
