DiPirro v. Centuri Corporation, et al.

In a settlement agreement executed on March 6, 2001, Proposition 65 private enforcer and whistleblower, Michael DiPirro, and fuel manufacturer, Centuri Corporation, agreed to terms resolving DiPirro's allegation that Centuri sold fuel products that expose users to nitromethane without providing the health hazard warning required by Proposition 65. Nitromethane is listed pursuant to Proposition 65 as a chemical known to cause cancer.

The terms of the settlement require Centuri to provide specific health hazard warnings regarding the risks associated with exposures to nitromethane. Additionally, Centuri is required to make settlement payments totaling $20,000. A portion of the settlement payment includes civil penalties that are allocated between the California Office of Health Hazard Assessment (75%) and DiPirro (25%). A portion of the settlement payments will go to DiPirro to reimburse reasonable attorneys' fees and costs incurred investigating, bringing the matter to Centuri's attention, litigating, and negotiating a settlement of the private enforcement action in the public interest.
