DiPirro v. Cobra Anchors Corp., et al.

An out-of-court Settlement Agreement was entered into between private citizen enforcer Michael DiPirro and Cobra Anchors Corp. The Settlement Agreement was finalized on May 14, 2002, and it resolved DiPirro's allegations that Cobra sold certain lead anchors and kits containing lead anchors in the State of California without providing the requisite Proposition 65 health hazard warnings.

As part of the settlement, Cobra agreed that it will not knowingly ship, or cause to be shipped, any lead anchors and kits containing lead anchors after May 15, 2002, unless the lead anchors and kits containing lead anchors have Proposition 65 health hazard warnings (as defined in Section 1.1 of the Settlement Agreement).

The Settlement Agreement requires settlement payments of $11,075, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
