DiPirro v. Contact East, Inc., et al.

On February 7, 2000, citizen enforcer Michael DiPirro, and settling party Contact East, Inc. entered into an out-of-court Settlement Agreement, which resolved DiPirro's allegations that Contact East sold certain Edsyn, Pace, and Antex soldering irons which produce fumes or gases which contain or may otherwise bring a user of the products in contact with chemicals listed pursuant to Proposition 65, including the heavy metal lead, in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Contact East agreed to sell and distribute only covered products that are accompanied by the Proposition 65 warnings pursuant to Paragraph 1 of the Agreement.

The Settlement Agreement requires settlement payments of $18,500, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
