DiPirro v. Fusion Incorporated, et al.

Citizen enforcer Michael DiPirro and defendant Fusion Incorporated executed a Consent Judgment on October 4, 2001, which the Superior Court of California County of Alameda subsequently approved, which resolved DiPirro's allegations that Fusion sold solders and brazing pastes containing the heavy metal lead and/or nickel in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Fusion agreed to provide its direct customers with warning information letters on an annual basis, and provide those customers with warning stickers to affix to product packaging for products intended for sale in California.

The Consent Judgment requires settlement payments of $5,000, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
