DiPirro v. Gifts.com, Inc., formerly known as Good Catalog Co., et al.

Citizen enforcer Michael DiPirro reached a settlement agreement with Gifts.com, Inc., formerly known as Good Catalog Co., on December 21, 2001 that was later entered by the Alameda County Superior Court. This enforcement action resolved the allegations of DiPirro that defendant Gifts.com, Inc. sold certain wine glasses, decanters and other crystalware that contained lead, in the State of California, without providing the requisite health hazard warnings.

As part of the settlement, Gifts.com agreed to not knowingly sell any product in the state of California unless such product complies with the warning requirements set out in Section 1.1 of the Agreement. The warning requirements established the standards for warnings on product labeling, in mail order catalogs, and on internet web sites.

The Consent Judgment requires settlement payments of $16,500, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
