DiPirro v. H.B. Fuller Company, et al.

Citizen enforcer Michael DiPirro and H.B. Fuller Company entered into an out-of-court Settlement Agreement on January 10, 2001.  The Settlement Agreement resolved DiPirro’s allegations that H.B. Fuller sold waterproof sealer containing toluene in the State of California without providing the requisite health hazard warnings. 

As part of the settlement, H.B. Fuller agreed to initiate revisions to its health hazard warnings for its waterproof sealer to provide the language set forth in Section 1.1 of the agreement.  As of January 1, 2001, H.B. Fuller agreed that it would not knowingly ship (or cause to be shipped) any waterproof sealer containing toluene for sale in California unless it contained the agreed upon warning language.  As a result of H.B. Fuller’s cooperation, voluntary efforts, and the minimal sales of the waterproof sealer, DiPirro agreed to waive the imposition of civil penalties. 

The Settlement Agreement requires settlement payment of $7,200 as compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
