DiPirro v. Hodgman, Inc., et al.

Citizen enforcer Michael DiPirro and settling defendant Hodgman, Inc. entered into an out-of-court Settlement Agreement on May 11, 2000.  This Agreement was later brought before the Alameda County Superior Court for approval.  The Settlement Agreement resolved DiPirro’s allegations that Hodgman sold repair kits with glue and other adhesives containing toluene in the State of California without providing the requisite health hazard warnings. 

As part of the settlement, Hodgman agreed that, beginning on April 30, 2000, it will not knowingly ship (or cause to be shipped) any products for sale in California unless such products comply with the health hazard warning language set out in Section 1.1 of the Agreement.  DiPirro agreed to waive a portion of the civil penalties to be paid by Hodgman, if Hodgman certifies in writing, by March 31, 2001, that it has removed all traces of toluene from or discontinued the sale in California of, the Felt Sole Replacement Kit.

The Settlement Agreement requires settlement payments of $32,800 divided therein between civil penalties, 75% of which are paid to California’s Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
