DiPirro v. HomeBase, Inc., et al.

Citizen enforcer Michael DiPirro and HomeBase, Inc. entered into an out-of-court Settlement Agreement on July 13, 2000.  This Agreement was later brought before the Alameda County Superior Court for approval.  The Settlement Agreement resolved DiPirro’s allegations that HomeBase sold anchoring and floor repair products that contain lead, formaldehyde, and toluene in the State of California without providing the requisite health hazard warnings. 

As part of the settlement, HomeBase agreed not to sell the covered products containing lead in California unless such products contain the proper health hazard warning language pursuant to Section 1.1 of the Agreement.

The Settlement Agreement requires settlement payments of $15,000 divided therein between civil penalties, 75% of which are paid to California’s Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
