DiPirro v. Inland Craft Products Company, et al.

Citizen enforcer Michael DiPirro reached a settlement agreement with Inland Craft Products Company on October 3, 1999. This resolved allegations by DiPirro that defendant Inland Crafts manufactures and/or distributes products in the State of California which may be used in a way that produces an exposure to lead without providing the requisite health hazard warnings. The agreement was later brought before Superior Court of San Francisco for approval.

Under the settlement agreement, Inland Craft agreed to immediately revise its product labeling to ensure that all products in its possession intended for shipment into California are packaged using revised labels, and that it will cease shipment of any products into California unless each product contains the specific warning provided in the settlement agreement on its label after January 1, 2000. Further, Inland Craft agreed to affix a warning label to any existing products entering California which do not already have a warning on its package.

The Consent Judgment required settlement payments of $11,700, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
