DiPirro v. Midwest Model Aircraft Company d/b/a K & S Engineering, et al.

Citizen enforcer Michael DiPirro and Midwest Model Aircraft Company d/b/a K & S Engineering entered into a settlement agreement on February 14, 2000, later approved and entered as a Consent Judgment by the Alameda County Superior Court, which resolved DiPirro's allegations that K & S sold soldering equipment containing the heavy metal lead and the toxin formaldehyde in the State of California without providing the requisite health hazard warnings.

As part of the settlement agreement, K & S agreed to place Proposition 65 health hazard warnings on the covered products.

The Consent Judgment required settlement payments of $6,800, to be divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and the remainder as compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
