DiPirro v. Outdoor World, Inc., et al.

Citizen enforcer Michael DiPirro and Outdoor World, Inc. entered into an out-of-court Settlement Agreement on July 7, 2000.  This Agreement was later brought before the Alameda County Superior Court for approval.  The Settlement Agreement resolved DiPirro’s allegations that Outdoor World sold fishing products, sporting products, hunting products, and archery products containing lead and toluene in the State of California without providing the requisite health hazard warnings. 

As part of the settlement, Outdoor World agreed that it shall not sell (or cause to be sold on its behalf) any of the products for sale or use in California unless each such product is accompanied by the proper health hazard warning pursuant to Section 1 of the Agreement.

The Settlement Agreement requires settlement payments of $7,500, divided therein between civil penalties, 75% of which are paid to California’s Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
