DiPirro v. Phillips ECG Products, et al.

The Superior Court of Alameda entered a Consent Judgment in DiPirro v. Phillips ECG Products, et al. (No. H217589-8) on May 2, 2001 which resolved citizen enforcer Michael DiPirro's allegations that Phillips sold certain soldering kits and soldering irons containing the heavy metal lead and formaldehyde in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Phillips immediately ceased all sales of the covered products in California. Phillips further agreed that were it to recommence sales in California, the products would have Proposition 65 warnings provided.

The Consent Judgment requires settlement payments of $27,000, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
