Citizen enforcer Michael DiPirro and settling defendant Professional Tool Manufacturing, LLC ("Professional Tool") entered into an out-of-court Settlement Agreement on December 19, 2001, which resolved DiPirro's allegations that Professional Tool sold power tools and diamond grinding wheels whose use and application is likely to produce fumes containing lead, crystalline silica, arsenic, chromium, and nickel in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Professional Tool agreed not to sell any power tools or diamond grinding wheels in California after March 15, 2002, unless the tools and wheels have Proposition 65 warnings provided.

The Settlement Agreement requires settlement payments of $11,750, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
