In the case DiPirro v. Rent X Equipment Rentals, the two parties executed a Consent Judgment on August 29, 2001, which resolved citizen enforcer Michael DiPirro's allegations that the defendant Rent X Equipment Rentals ("Rent X") rented welding machines, power sources, and other welding equipment that produced fumes containing chemicals such as nickel, chromium, and carbon monoxide in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Rent X agreed not to sell any welding machines, power sources, or other welding equipment in California after September 15, 2001, unless the products have Proposition 65 warnings provided. The settlement sum does not include additional fees and costs should the office of the Attorney General require further information or need to clarify relevant facts about the case.

The Consent Judgment requires settlement payments of $10,000, to be divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
