A Consent Judgment was executed in DiPirro v. Target Stores, Inc.; Dayton Hudson Corporation, et al., on March 29, 2001, which resolved citizen enforcer Michael DiPirro's allegations that the defendants Target Stores, Inc. ("Target") and Dayton Hudson Corporation ("Dayton") sold fishing tackle products containing the heavy metal lead in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Target agreed not to sell any fishing tackle products in California after March 12, 2001, unless the fishing tackle products have Proposition 65 warnings provided.

In consideration of Target's efforts to comply with the Consent Judgment, DiPirro agreed to waive all claims for monetary payments in the form of civil penalties. As compensation for DiPirro and his counsel's investigating, litigating, and negotiating a settlement in the public interest, Target shall pay a total sum of $2,000.
