Citizen enforcer Michael DiPirro's allegations against the party Unique Sports Products Inc. ("Unique Sports") were resolved on March 14, 2001, when the parties entered into an out-of-court Settlement Agreement. DiPirro had alleged that Unique Sports manufactured or distributed tape containing the heavy metal lead in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Unique Sports agreed not to distribute or sell in California any of the tape identified in Exhibit A of the Settlement Agreement after April 15, 2001, unless the tape has Proposition 65 warnings provided.

The Settlement Agreement requires settlement payments of $3,900, to be divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower DiPirro and his counsel for their successful enforcement of this matter in the public interest.
