Held v. STK International, Inc., Save Mart Supermarkets, Food Maxx, et al.

On April 24, 2009, the Alameda County Superior Court entered a Consent Judgment in Held v. Toys "R" Us, Inc.; et al., which resolved citizen enforcer Anthony E. Held, Ph.D., P.E.'s allegations that the defendants Save Mart Supermarkets ("Save Mart") and Food Maxx ("Food Maxx") sold infant's and children's items containing the phthalate chemical di(2-ethylhexyl)phthalate ("DEHP") in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Save Mart and Food Maxx agreed not to sell any My Baby Products 3pc PVC Baby Bibs, BI-232 (#7 88914 30437 6) in California unless the bibs contain no more than .1% DEHP when analyzed using state or federally approved testing methodologies. Additionally, Save Mart and Food Maxx shall require written certification that its suppliers only supply bibs that meet those standards.

The Consent Judgment requires settlement payments of $16,000, to be divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower Held and his counsel for their successful enforcement of this matter in the public interest.
