The San Francisco County Superior Court entered a Consent Judgment in Leeman v. 26 California Bazar, Inc., et al. on August 31, 2004. The settlement resolved the allegations of citizen enforcer Whitney R. Leeman, Ph.D. that defendant 26 California Bazar, Inc. sold certain glassware products with colored artwork and/or designs on the exterior of the glass with materials in the colored artwork and/or designs that contain lead (or lead compounds) in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Bazar agreed not to sell or offer for sale any glassware products with colored artwork and/or designs in California after December 30, 2003, unless such glassware products comply with the reformulation standards set forth in Section 2.4 of the settlement agreement or bear Proposition 65 health hazard warnings pursuant to Section 2.2 of the settlement agreement.

The Consent Judgment required settlement payments of $18,000, divided therein between civil penalties, 75% of which were paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower Dr. Leeman and her counsel for their successful enforcement of this matter in the public interest.
