Leeman v. Lyon Designs, Inc., et al.

On August 21, 2004, citizen enforcer Whitney R. Leeman, Ph.D., and settling defendant Lyon Design, Inc. entered into an out-of-court Settlement Agreement, which resolved Leeman's allegations that Lyon sold certain glass containers with colored artwork or designs containing lead in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Lyon agreed not to ship, or cause to be sold, glass containers with colored artwork or designs after October 31, 2004 unless the products bear Proposition 65 warnings or are reformulated to eliminate the presence of lead in the products as defined in Section 2.4 of the Settlement agreement.

The settlement required payments of $42,000, divided therein between civil penalties, 75% of which were paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower Leeman and her counsel for their successful enforcement of this matter in the public interest.
