The San Francisco County Superior Court entered a Consent Judgment in Leeman v. Onward Manufacturing Company Limited, et al., on December 5, 2005, which resolved citizen enforcer Dr. Whitney R. Leeman's allegations that Onward Manufacturing Company Limited ("Onward") sold BBQ touch-up paint containing toluene in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Onward agreed to provide Proposition 65 warnings for the paint offered for sale in California. Onward committed to affix specific health hazard warnings to the label of the products containing toluene that it manufactured after November 28, 2005.

The settlement requires settlement payments of $10,000, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower Dr. Leeman and her counsel for their successful enforcement of this matter in the public interest.
