Moorberg v. Tara Toy Corp.

Citizen enforcer Mark Moorberg and settling party Tara Toy Corp. (“Tara Toy”) entered into an out-of-court settlement agreement on June 26, 2015.  Moorberg had alleged that Tara Toy sold children’s purses containing the heavy metal lead in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Tara Toy agreed not to sell any children’s purses in California after September 1, 2015, unless the purses contain less than 90 parts per million of lead in any accessible component when analyzed using state or federally approved testing methodologies.

The Settlement Agreement requires settlement payments of $12,000, divided therein between civil penalties, 75% of which are paid to California’s Office of Environmental Health Hazard Assessment, and compensation to citizen enforcer Moorberg and his counsel for their successful enforcement of this matter in the public interest.
