Moore v. C-Line Products, Incorporated

On September 1, 2011, citizen enforcer John Moore and settling defendant C-Line Products, Inc. ("C-Line"), entered into an out-of-court Settlement Agreement in Moore v. C-Line Products, Incorporated, which resolved Moore's allegations that C-Line sold ID cases containing excessive amounts of the phthalate chemical di(2-ethylhexyl)phthalate ("DEHP") in the State of California without providing the requisite health hazard warnings.

As part of the settlement, C-Line agreed not to sell any ID cases in California after September 12, 2011, unless the ID cases contain less than 1,000 parts per million of DEHP in each accessible component when analyzed using state and federally approved testing methodologies. C-Line also agreed to place Proposition 65 warnings on ID cases that do not comply with reformulation standards. As C-Line eliminated the need for Proposition 65 warnings by January 1, 2012, Moore waived a portion of the civil fine that would otherwise be applied.

The Settlement Agreement requires settlement payments of $34,500, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower Moore and his counsel for their successful enforcement of this matter in the public interest.
