Moore v. Star Asia, U.S.A., LLC, et al.

On November 16, 2012, the Alameda County Superior Court entered a Consent Judgment in Moore v. Star Asia, U.S.A., LLC; et al., which resolved citizen enforcer John Moore’s allegations that the defendant Star Asia, U.S.A., LLC (“Star Asia”) sold tools with grips containing the phthalate chemical di(2-ethylhexyl)phthalate (“DEHP”) in the State of California without providing the requisite health hazard warnings. 

As part of the settlement, Star Asia shall not sell the specific tools with grips identified in the Consent Judgment in California after December 31, 2012, unless the tools qualify as reformulated pursuant to Section 2 of the Consent Judgment.  Should Star Asia comply with the heightened standards of Section 2 of the Consent Judgment by December 31, 2012, Moore agreed to waive a portion of the civil fine that would otherwise be applied.

The Consent Judgment requires settlement payments of $52,000, divided therein between civil penalties, 75% of which are paid to California’s Office of Environmental Health Hazard Assessment, and compensation to whistleblower Moore and his counsel for their successful enforcement of this matter in the public interest.
