Moore v. Trade Associates Group, Ltd.

On August 22, 2012, the San Francisco County Superior Court entered a Consent Judgment in Moore v. Trade Associates Group, Ltd., which resolved citizen enforcer John Moore's allegations that the defendant Trade Associates Group, Ltd. ("Trade Associates") sold coverings for books containing the phthalate chemical di(2-ethylhexyl)phthalate ("DEHP") in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Trade Associates agreed not to sell any coverings for books after March 8, 2012, unless the coverings contain less than 0.1 percent (1,000 parts per million) of DEHP in each accessible component when analyzed using state or federally approved testing methodologies. Due to Trade Associate's commitment to comply with these heightened standards, Moore agreed to credit Trade Associates with a portion of the civil penalties that would otherwise be applied.

The Consent Judgment requires settlement payments of $33,250, divided therein between civil penalties, 75% of which are paid to California's Office of Environmental Health Hazard Assessment, and compensation to whistleblower Moore and his counsel for their successful enforcement of this matter in the public interest.
