Vinocur v. Laura Geller Beauty, LLC

On December 12. 2016, citizen enforcer Laurence Vinocur and settling party Laura Geller Beauty, LLC (“Laura Geller”) entered into an out-of-court settlement agreement.  Vinocur had alleged that Laura Geller sold sunscreen products containing the chemical benzophenone in the State of California without providing the requisite health hazard warnings.

As part of the settlement, Laura Geller agreed not to sell any sunscreen products in California after June 1, 2017, unless the products contain less than 35 parts per million of benzophenone when analyzed using state or federally approved testing methodologies.  Laura Geller has also agreed to notify its vendors of the reformulation standards and instruct them to comply expeditiously.

The Settlement Agreement requires settlement payments of up to $41,000, divided therein between civil penalties, 75% of which are paid to California’s Office of Environmental Health Hazard Assessment, and compensation to citizen enforcer Vinocur and his counsel for their successful enforcement of this matter in the public interest.
