TCG client Peter Englander has filed a lawsuit in Marin County Superior Court against The Home Depot, Inc., alleging that Home Depot manufactured, distributed, and sold vinyl/PVC toilet seats to consumers in California without warning them that the toilet seats exposed them to the phthalate chemical DEHP. DEHP is known to the State of California to cause birth defects and other reproductive harm. California's Office of Environmental Health Hazard Assessment has given notice of its intent to list vinylidene chloride as a chemical known to the State of California to cause cancer for purposes of Proposition 65. It's also proposing to adopt a No Significant Risk Level (NSRL) for vinylidene chloride of .88 micrograms a day.
